Norfolk Southern Train Derailment: $600M Settlement Update
This week marked a pivotal moment in the aftermath of the Norfolk Southern train derailment in East Palestine, Ohio, as a proposed $600 million settlement received provisional approval. The settlement aims to compensate thousands of residents and businesses affected by the toxic chemical spill that occurred last year.
Judge Benita Y. Pearson of the Northern District of Ohio granted this preliminary approval, setting the stage for the resolution of numerous claims related to property damage, loss of income, environmental contamination, and health risks stemming from exposure to hazardous materials like vinyl chloride.
The settlement covers claims within a 20-mile radius of the derailment site and includes personal injury claims within a 10-mile radius. This development is a significant step towards justice for those impacted by the incident.
In addition to Norfolk Southern, the settlement addresses claims against other parties involved in transporting the hazardous materials, including OxyVinyls LP, Trinity Industries Leasing Co., GATX Corp., and General American Marks Co.
Lieff Cabraser, serving on the Plaintiffs Executive Committee, played a crucial role in negotiating this settlement. A final approval hearing is scheduled for September 25th, 2024, which will determine the ultimate outcome of this significant legal action.
