Norfolk Southern Train Derailment: $600 Million Settlement Moves Forward

This week saw a significant development in the aftermath of the Norfolk Southern train derailment in East Palestine, Ohio, as a proposed $600 million settlement gained preliminary approval. The settlement seeks to provide compensation for thousands of residents and businesses impacted by the toxic chemical spill that occurred last year.

Judge Benita Y. Pearson of the Northern District of Ohio granted provisional approval, paving the way for resolving numerous claims. These include property damage, loss of income, environmental contamination, and health concerns linked to hazardous materials such as vinyl chloride.

The settlement is designed to cover claims within a 20-mile radius of the derailment site, with personal injury claims extending to a 10-mile radius. This marks a significant milestone in addressing the damages and risks endured by the affected communities.

Beyond Norfolk Southern, the settlement also resolves claims against other parties involved in the transportation of hazardous materials, including OxyVinyls LP, Trinity Industries Leasing Co., GATX Corp., and General American Marks Co.

Lieff Cabraser, a key member of the Plaintiffs Executive Committee, was instrumental in negotiating this landmark settlement. A final approval hearing is scheduled for September 25th, 2024, which will determine the resolution of this complex legal case and the distribution of the settlement funds.
